Welcome to Education & Evolution (“E&E”), operated by C. Beach Consulting, LLC. These Terms of Use & Service Terms (“Terms”) govern your use of eduevol.com, E&E resources, and services purchased or obtained through E&E.
By accessing this website, purchasing a service, submitting payment, or engaging E&E to begin work, you acknowledge and agree to these Terms.
E&E Services
E&E provides strategic consulting and professional services that may include business and nonprofit development, strategic planning, grant coaching, grant strategy, proposal development, funding-related support, and related resources.
The specific scope of work depends on the service selected and any written description, proposal, invoice, or other communication applicable to that engagement.
Client Responsibilities
Successful completion of E&E services requires active and timely client participation.
Clients are responsible for:
- Providing accurate, complete, and truthful information
- Supplying documents and materials reasonably requested by E&E
- Responding to requests for information, review, or approval within necessary timeframes
- Reviewing documents and confirming factual and organizational information
- Meeting responsibilities and deadlines communicated during the engagement
- Maintaining access to accounts, registrations, organizational records, or other materials required for their project
- Promptly notifying E&E of material changes that may affect the work
E&E is entitled to rely on information supplied by the client and is not responsible for inaccuracies, omissions, delays, missed opportunities, or other consequences resulting from incomplete, inaccurate, or untimely information provided by the client.
If a client fails to provide required information, documentation, decisions, approvals, access, or other necessary cooperation, E&E may pause, reschedule, modify, or discontinue work affected by that failure.
E&E is not responsible for missed deadlines or incomplete deliverables resulting from a client’s failure to fulfill these responsibilities.
Grant and Funding Services
E&E provides professional strategy, coaching, research, writing, and related support intended to help clients pursue competitive funding opportunities.
E&E does not guarantee grant awards, funding, investment, approval, or any particular financial outcome.
Funding decisions are made solely by independent funders, agencies, foundations, corporations, governmental entities, and other third parties over whom E&E has no control.
Where a specific E&E service expressly includes continued proposal submissions or support until one proposal is funded, that commitment applies only according to the published scope of that service and while the client continues to satisfy all responsibilities necessary for E&E to perform the work.
Such a commitment does not constitute a guarantee that funding will ultimately be awarded.
Scope of Services
E&E will provide the services included in the client’s selected offering.
Requests outside the stated scope may require a separate service, additional fee, or written agreement.
Timelines may vary depending on project complexity, client responsiveness, third-party deadlines, funding cycles, and other circumstances outside E&E’s reasonable control.
Fees and Payment
Prices are presented on the E&E website, invoice, proposal, or other applicable written communication.
Payment constitutes authorization for E&E to begin allocating time, resources, research, preparation, or other work toward the engagement.
Any payment schedule or special arrangement agreed to in writing becomes part of the applicable service terms.
Cancellations and Refunds
Because E&E provides professional services involving reserved time, strategy, research, preparation, intellectual work, and customized deliverables, payments may become non-refundable once substantive work on a purchased service has begun.
If an engagement cannot proceed because the client fails to provide required information, documents, approvals, access, communication, or other necessary participation, such failure does not automatically entitle the client to a refund.
Any refund, credit, rescheduling, or other accommodation will be determined based on the circumstances of the engagement, work already performed, commitments already made, and applicable law.
Nothing in these Terms limits any non-waivable rights available to a consumer under applicable law.
Intellectual Property
Unless otherwise stated, E&E retains ownership of its proprietary methods, frameworks, templates, processes, training materials, website content, graphics, guides, and other original intellectual property.
Clients may use final customized deliverables prepared specifically for their organization or project for their intended internal and organizational purposes.
E&E proprietary materials may not be reproduced, resold, republished, distributed, or commercially exploited without written permission.
Website Resources
Resources made available through eduevol.com are provided for educational and informational purposes unless expressly identified as part of a paid professional service.
Downloading or using a resource does not create a consulting relationship and does not constitute legal, financial, tax, accounting, or other regulated professional advice.
Third-Party Services and Opportunities
E&E may reference or link to third-party websites, funders, programs, platforms, software, or other resources.
E&E does not control and is not responsible for third-party availability, requirements, decisions, policies, website content, deadlines, technical performance, or changes.
Clients are responsible for reviewing and complying with applicable third-party requirements.
Limitation of Responsibility
E&E will perform its services professionally and in good faith based on the information available at the time the work is performed.
To the extent permitted by applicable law, E&E is not responsible for indirect or consequential losses arising from third-party decisions, changes in funding opportunities, client-provided information, missed client responsibilities, technical failures outside E&E’s control, or circumstances E&E could not reasonably prevent.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Privacy
Use of personal information submitted through the E&E website is governed by the E&E Privacy Policy.
Changes to These Terms
E&E may revise these Terms as its services or business practices evolve. Updated Terms will be posted on the website with a revised “Last Updated” date.
Terms applicable to an already-purchased service will not be materially changed retroactively solely by posting a later website revision where doing so would conflict with applicable law or an existing written agreement.
Governing Law
These Terms are governed by applicable laws of the State of Illinois, without regard to conflict-of-law principles, except where applicable law requires otherwise.
